Usually, a lien holder who has forced the sale of property through foreclosure has little interest in whether the property is occupied. Therefore, Florida Statutes and most foreclosure final judgments anticipate that a purchaser will seek possession of an occupied property. If the occupant of the property is the prior owner, the foreclosure final judgment will generally give the purchaser a straightforward method of getting possession. The process is a bit more complex when the occupant of the property is a former tenant with a bonafide lease agreement; State and Federal laws give tenants in possession of foreclosed property very specific legal protections, including notice requirements that must be followed.
